These Terms and Conditions (“Terms”) govern your use of services provided by CreateWithDiana.com (“we,” “us,” or “our”), including the Local Brand Authority Program and Promotional Products for Brand Businesses, and any related content creation, marketing, or product services. By purchasing our services, you agree to these Terms.
1. Services
We provide:
Local Brand Authority Program: Social media content creation, strategy planning, and guidance. Services include short-form videos, content calendars, captions, hashtags, and strategic guidance.
Promotional Products for Brand Businesses: Custom products such as apparel, drinkware, office items, and other branded merchandise designed to increase visibility, loyalty, and recognition. Services include design, mockups, printing, and delivery.
2. Client Responsibilities
To provide effective services, you agree to:
Provide accurate business information and materials (logos, photos, video clips, text, product requirements).
Ensure you have rights or permissions for all content and logos provided.
Review and approve content or product mockups promptly.
Share materials via email or cloud services as requested.
3. Payment and Billing
Services are billed according to the selected package.
Payment must be received before services begin or products are printed.
Late payments may delay content creation or product delivery.
Prices are subject to change for new clients, but existing agreements remain at the agreed rate.
4. Content and Product Ownership
For the Local Brand Authority Program, all content remains the property of CreateWithDiana.com until full payment is received.
For Promotional Products, the designs remain our property until production and payment are complete.
After payment, clients are granted a license to use the content or products for business purposes only.
5. Revisions and Approvals
Content revisions are included as outlined in your package. Additional revisions may incur extra fees.
Product design mockups must be approved before printing. Changes after approval may incur additional costs.
6. Limitation of Liability
We strive to deliver high-quality services and products, but results may vary based on client input, market conditions, or platform algorithms.
CreateWithDiana.com is not liable for any direct or indirect losses, including lost revenue or opportunities, resulting from use of our services or products.
7. Termination and Cancellation
Clients may cancel services at any time by notifying us via email.
No refunds are provided for services or products already delivered or in production.
Pending content or product orders remain our property until payment is complete.
8. Governing Law
These Terms are governed by the laws of the State of Louisiana, USA. Any disputes will be resolved in the courts of Lafayette Parish, Louisiana.
